MAGISTERIAL COURT’S DECREE TO EXTEND POLICE CUSTODY CHALLENGED

Asad Khan, one of the suspects arrested for his alleged involvement in serial bomb blasts in Pune, has challenged the authority of the magisterial court to extend his police custody. The Criminal Revision Petition, filed by advocate Mehmood Pracha, a renowned Supreme Court lawyer and lawyers Shahid Akhtar and M M Sayyed on 18 January, came up for hearing before the court of additional sessions judge V V Bambarde on 31 January. Public Prosecutor, Ujjwala Pawar, appearing on behalf of the State Anti-Terrorists Squad, sought time to reply to the petition. The hearing was postponed till 5 February.  Khan has prayed that the magisterial court order, which was issued on 1 January extending his and seven others’ police custody till January 8, be set aside. He has pleaded that the police custody be declared illegal. The lawyers representing the 8 suspects had raised the issue of the jurisdiction of the magisterial court hearing remand pleas of the ATS, invoking sections of UAPA, and of the ATS’ authority to investigate the blasts case, among other issues, but their pleas were rejected.
